Terms of service and acceptable use

Plain terms for a free service whose content we cannot read.

Plain rules for a small service. notekill.com provides self-destructing notes, encrypted file sharing and ephemeral chat. These terms apply when you use it.

The service

The service is free. There is no paid tier, and there is no account: none is needed and none can be created. It is provided as available; we make no commitment about uptime or continuity. Notes self-destruct after being read, files can be up to 25 MB, and a chat room is deleted, with every message in it, once nobody has it open any more.

Acceptable use

You must not use the service to distribute malware, to phish, to share child sexual abuse material, to harass anyone, to send spam, or for any other unlawful purpose. The prohibition attaches to your conduct, not to categories of content we could inspect, because we cannot inspect any of it.

How enforcement works

Everything you upload is encrypted in your browser before it reaches us. We cannot scan stored content, and we do not. Enforcement is therefore reactive: it starts when someone reports a specific link. One consequence deserves emphasis: deleting a reported item destroys it for everyone, including the intended recipient. There is no partial measure available for content we cannot read.

Reporting abuse

To report abuse, email contact@notekill.com with:

  1. The link or identifier. Without it we cannot locate the item.
  2. The reason. Why you believe the item is unlawful or breaches these terms.
  3. Your statement. That you are reporting in good faith and that the information given is accurate.

Never send the part of the link after the # symbol. We do not need it to act on your report, and with it the report would hand us the decryption key.

The single point of contact for authorities and for users, including for the purposes of the EU Digital Services Act, is contact@notekill.com.

When we disable something

We usually cannot notify the uploader of a removal. We hold no accounts and no contact details, so in most cases there is no one we can write to. If your link stops working, this page is the only notice we can give.

Cooperation with authorities

We comply with valid Romanian and EU legal orders. What such an order can actually yield is constrained by the design: we store ciphertext, and the decryption keys never reach the server. The security page sets out what we hold.

Liability

The service is provided as is, without warranties, to the extent permitted by Romanian law. Liability for intent and gross negligence cannot be excluded and is not excluded.

Governing law

These terms are governed by Romanian law. Consumers may contact the National Authority for Consumer Protection, ANPC (anpc.ro).

Changes

We may amend these terms. The current version is always the one published at this address, and changes take effect when published.
